B.C. man gets 3.5 years in jail for sexual assault, forcible confinement

A Surrey man will spend 3.5 years in prison for sexual assault and forcible confinement.

A Surrey man who has four children by prostitutes and three with his wife will spend three and a half years in prison for sexual assault and forcible confinement, a B.C. Supreme Court judge has ruled.

The ruling, handed down April 8 but released Thursday, found Floyd Broxton Peart guilty of sexual assault in an offence that dates to March 5, 2017.

“The sexual assault was accompanied by physical violence, and verbal intimidation and degradation,” said Justice Veronica Jackson in the ruling.

Glacier Media has chosen not to publish disturbing details of the offence found in the court ruling.

In a victim impact statement to the court, the assaulted woman said she experienced physical pain throughout her body in the wake of the sexual assault. She had trouble sleeping and suffered from nightmares. Emotionally, she has lost her ability to trust people and finds herself jumping or jerking when men touch her. The statement also said her sense of self‑worth has suffered.

“No words I can offer, or sentence I can impose, will undo the physical and emotional harm suffered by A.B.,” Jackson wrote, using the woman's initials.

Peart had three children with his wife and four children with four different women described by Peart as “working girls,” according to the ruling.

“Mr. Peart is in significant arrears of his child support obligations,” Jackson said.

Peart has already been convicted of 46 crimes, including possession of goods obtained by crime over $5,000, theft under $5,000, a domestic assault, assault with a weapon, uttering threats, breach of court orders, controlled substances, drug trafficking in a controlled substance, breaking and entering and living on the avails of prostitution.

Jackson sentenced Peart to three and a half years for the sexual assault and 12 months to be served concurrently for the forcible confinement.

The Crown sought four years' imprisonment for the sexual assault and one year of imprisonment for the forcible confinement to be served concurrently.

Defence counsel submitted that a fit sentence for the sexual assault was between two years less a day and three and a half years.
