Port Moody woman sues Walmart for fall over forklift at Burnaby store

An alleged fall over a forklift at the Lougheed Walmart has led to a lawsuit in B.C. Supreme Court.

A Port Moody woman in suing Walmart and Lougheed Mall for an alleged fall over a forklift that she claims resulted in broken ribs, a punctured lung and other injuries.

Hoda Rashidi says she was walking down an aisle of the Walmart Supercentre at Lougheed Mall on Feb. 25, 2022, when she tripped over a forklift and fell, according to a notice of civil claim filed in B.C. Supreme Court on Sept. 12.

Rashidi suffered broken ribs, a “hole in lung,” collapsed lung, difficulty breathing, injury to her right foot, anxiety, fatigue and a low mood, according to the claim.

“These injuries have caused and continue to cause the plaintiff pain, suffering, loss of enjoyment of life, loss of housekeeping capacity, permanent physical disability, loss of physical, mental and emotional health, and loss of earnings, past and prospective,” states the claim.

The lawsuit alleges the fall was caused or contributed to by the negligence and breach of duty of Walmart and the mall.

It claims the defendants had a legal duty to maintain the store in “reasonably safe condition” and had failed to do so in a number of ways, including failing to inspect the premises for hazards, failing to provide adequate lighting, failing to warn Rashidi of hazards they knew or ought to have known about and failing to remedy those hazards.

Rashidi is suing for unspecified general and special damages.

None of her allegations have been tested in court, and neither Walmart Canada nor Lougheed Mall has yet responded to the suit.
